These terms and conditions ("Consumer Terms and Conditions") apply to your use of the Gift Card website ("Website") and when you purchase a Vienna Marriott Hotel Gift Card ("Gift Voucher").

SK Chase acts as agent for the Vienna Marriott Hotel in relation to the possibility of purchasing vouchers and is a company registered in Scotland (No. SC253912) with its registered office at 31 Palmerston Place, Edinburgh, EH12 5AP. The Vienna Marriott Hotel website has its own terms and conditions that apply to the use of this website (www.gutscheinshop.at).

Please read them carefully before placing your order. If you do not accept these terms and conditions, you will not be able to order products through the above-mentioned website.

The Consumer Protection Act applies to purchases by end consumers.

  1. Purchase

1.1 The Website offers gift vouchers for sale.

1.2 Gift vouchers may not be redeemed at the Vienna Marriott Hotel until the payment has been received on the account of the Vienna Marriott Hotel and no payment claim has been filed. The Vienna Marriott Hotel will invalidate unpaid vouchers in the system.

1.3 We recommend to double check the confirmation details for its accuracy and to keep a copy.

1.4 When purchasing a voucher via the Website the payment is made by credit or debit card. The following cards are accepted: Mastercard, Visa, Delta, American Express, Switch or Solo.

Vouchers can also be purchased at the voucher shop, the reception or at the Parkring Restaurant of the Vienna Marriott Hotel, Parkring 12a, 1010 Vienna.

The following cards are accepted: Mastercard, American Express, Visa, Diners, JCP. In addition, payments are also possible by debit card (EC) or cash.

1.5 You undertake that all details you provide for the purpose of ordering Gift Vouchers are accurate, that the credit or debit card you use is your own and that there are sufficient funds to cover the cost of the Gift Voucher ordered.

1.6 In order to protect your data during the order process, the Website uses a software package known as Secured Sockets Layer (SSL).

2.    Conditions for the purchase of gift vouchers

 

a.    Vouchers cannot be redeemed in cash[LB1]  or exchanged by new gift vouchers.

b.    The voucher must be handed over in printed form when redeemed.

c.    If the value of the consumption is lower than the value of the voucher, a refund of the difference is not possible (neither in cash nor as a new voucher).

d.    If the value of the consumption exceeds the value of the voucher, the difference must be paid on site.

e.    Children's policy for services at the Vienna Marriott Hotel applies to the Legendary Sunday Brunch, Saturday Shopping Brunch, Candlelight Dinner and All-American Breakfast: Children from 0-5 years are free of charge, from 6-11 years receive a 50% discount and from 12 years and over are charged the regular price.

f.     An invoice with tax identification can only be issued at the time of redemption of the voucher (VAT Act), as these are multi-purpose vouchers.

g.    The voucher is only valid after the payment has been received (see section 1.4).

h.    The price guarantee for the service printed on the voucher (e.g. Legendary Brunch, Candlelight Dinner, etc.) is redeemable for one year starting from the date of issue at no additional charge. After the price guarantee expires, prices may increase, and the difference must be paid on-site when redeeming the voucher.

i.      Customers who are consumers within the meaning of the Consumer Protection Act may withdraw from a contract concluded via distance selling (or a contractual declaration made via distance selling) within a period of fourteen days. The withdrawal period begins on the day of conclusion of the contract, with Saturdays and Sundays not counting as working days. It is sufficient if the declaration of withdrawal is sent within the stated period without stating reasons. However, the right of withdrawal does not exist if the performance of the service is already started within the withdrawal period as agreed.

j.      In principle, all vouchers are value vouchers and can be used for all services provided by the Vienna Marriott Hotel. Furthermore, the value vouchers are subject to the statutory expiration period.

k.    If vouchers are purchased for a specific day, the option to redeem them before or after that date expires. In this case, the invoice will be issued with the prescribed VAT at the time of purchase.

 

2.2 The following delivery options are available to customers:

 

  1. Cancellations

3.1 Please note that in addition to the terms and conditions contained in these Consumer Terms and Conditions, the terms and conditions applicable to each Gift Voucher are specific for each Gift Voucher and can be viewed on the Website in connection with each Gift Voucher. The following provisions in this Section 3 apply to all Gift Vouchers, except:

(a) the Gift Voucher is valid for a specific date or service period

3.2 Any specific arrangements regarding booking dates and times must be made directly with the Vienna Marriott Hotel. We recommend confirming the agreed dates with the Vienna Marriott Hotel to make every reasonable effort to accommodate your request subject to availability and policies.

3.3 Nothing in the Consumer Terms and Conditions or the additional terms and conditions applicable to Gift Vouchers changes or affects your statutory rights (including your right to a refund for incorrect or misdescribed Gift Vouchers).

3.4 Vouchers purchased in the online shop (www.gutscheinshop.at) can be canceled free of charge within the statutory cancellation period according to consumer protection regulations. The voucher will be invalidated in the Vienna Marriott Hotel’s system. The Vienna Marriott Hotel will refund the amount paid within 14 days of receiving the cancellation notice.

3.5 If you have already received the canceled Gift Voucher, you must destroy it. If the Vienna Marriott Hotel discovers, after receiving your cancellation notice, that the canceled gift voucher has already been used, you are not entitled to receive a refund. The Vienna Marriott Hotel is not liable for theft or loss.

  1. Liability

5.1 In the Vienna Marriott Hotel breaches the contract, the Vienna Marriott Hotel is only responsible for reimbursing the cost of the gift voucher. The Vienna Marriott Hotel is not obligated to reimburse you for any other compensation or losses you may suffer as a result of the Vienna Marriott Hotel’s breach of contract.

5.2 The Vienna Marriott Hotel undertakes to provide the services for which the gift voucher was purchases, as described on the website (www.gutscheinshop.at) and the Vienna Marriott Hotel website (if applicable), at all times with reasonable skill and care, if still offered at the hotel. Since each voucher is a value voucher, all vouchers, can be used for all services offered at the Vienna Marriott Hotel, regardless of the intended use described on the voucher. The Vienna Marriott Hotel makes no other warranty or representation.

We or SK Chase are the owners or licensees of all copyrights, trademarks, design rights, patents and other intellectual property rights in this website and the material published on it. You may access the website and download parts of it to a PC for personal viewing, but for no other purpose. NONE OF THE CONTENT MAY BE DOWNLOADED, USED, DISTRIBUTED, TRANSMITTED, STORED, SOLD OR DISTRIBUTED WITHOUT OUR PRIOR WRITTEN CONSENT.

  1. Disclaimer

It is customary for contractual provisions and protective obligations of the contractual partner to be complied with and for the contractual partner to be liable for them. Notwithstanding the above, we have excluded this in point 7 below, and the consumer agrees to this when using the website.

By accessing and using the website or any of the information contained therein, you acknowledge that, although reasonable efforts have been made to ensure that all information contained on the Website is correct, accurate and up-to-date, neither SK Chase nor Vienna Marriott Hotel accepts any representations, warranties or commitments that the material on the website is free of harmful material,  viruses, worms, Trojan horses and/or other code with contaminating or destructive properties. (It is your responsibility to take protective measures, such as virus scanning).

 

  1. Governing Law and Jurisdiction

The website and the General Terms and Conditions for Consumers are governed by applicable law. You agree to submit to the exclusive jurisdiction of the courts of your jurisdiction in all matters relating to the use of the website and these Consumer Terms and Conditions. If any provision of these Consumer Terms and Conditions is found by a court of competent jurisdiction to be invalid, you agree that the other provisions of these Consumer Terms and Conditions will remain in full force and effect to the fullest extent possible.
